Terms of Service

1. Description of Service

OPHaul ("OPHaul", "we", "us", or "our") provides a web-based software platform located at https://www.ophaul.com that helps independent trucking owner-operators evaluate freight loads, track fuel purchases, calculate estimated IFTA (International Fuel Tax Agreement) obligations, and manage business cost data (collectively, the "Service").

The Service is intended for use by licensed commercial motor vehicle operators and transportation professionals in the United States and Canada.

2. Account Registration

To access the Service, you must create an account by providing a valid email address and password. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately at cpoole@revasyn.com if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. One person may not maintain more than one free trial account.

3. Free Trial and Subscription

Free Trial. New accounts receive a 7-day free trial with full access to the Service. A valid payment method is required to start a trial. The trial begins on the date your account is created and ends automatically after 7 days. You will not be charged until the trial period ends.

Paid Subscription. After the trial period ends, continued access to the Service requires a paid subscription at the then-current rate (currently $39.00 USD per month). Subscriptions are billed monthly on the date of subscription activation.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period unless required by applicable law.

Changes to Pricing. We reserve the right to change subscription pricing with at least 30 days written notice to your registered email address. Continued use of the Service after the pricing change takes effect constitutes your agreement to the new pricing.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Use the Service to violate any applicable federal, state, or local laws or regulations
• Attempt to gain unauthorized access to any part of the Service or its underlying systems
• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract source code from the Service
• Share your account credentials with any third party
• Use automated scripts, bots, or crawlers to access the Service
• Submit false, misleading, or fraudulent information to the Service
• Interfere with or disrupt the integrity or performance of the Service

5. Your Data

You retain full ownership of all data you input into the Service, including load information, fuel entries, mileage records, and business cost figures (collectively, "Your Data"). By using the Service, you grant OPHaul a limited, non-exclusive license to store, process, and display Your Data solely for the purpose of operating and improving the Service.

We do not sell Your Data to third parties. We will not share your individual load or business data with any third party except as required to operate the Service (e.g., cloud infrastructure providers) or as required by law. See our Privacy Policy for full details.

You are responsible for the accuracy of the data you enter. OPHaul does not independently verify data you provide.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPHAUL AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Intellectual Property

The Service, including its design, code, scoring algorithms, and content (excluding Your Data), is owned by OPHaul and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Termination

You may terminate your account at any time by contacting us at cpoole@revasyn.com or through your account settings.

We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice and without liability. Upon termination, your right to access the Service ends immediately. We will retain Your Data for 30 days following termination, after which it may be permanently deleted.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration under the American Arbitration Association rules, conducted in Texas. You waive any right to a jury trial or participation in a class action lawsuit.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at your registered address and update the effective date above. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
